1. Agreement
These Terms of Service (“Terms”) govern your use of velmira.ai (“velmira,” “we,” “us”). By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Eligibility
You must be at least 18 years old to use velmira.ai. By using the service, you represent that you are 18 or older and have the legal capacity to enter into this agreement.
3. The service
velmira.ai lets you describe a character in text, generates a reference portrait, and then generates new images of that character in scenes you describe. Image generation is performed by third-party AI models accessed through Replicate.
The service is provided on an as-is, best-effort basis. AI-generated output is non-deterministic — we make no guarantee that any specific prompt will produce a specific result.
4. Account
You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
5. Subscriptions, credits, and billing
Access to image generation requires either an active monthly subscription or a positive credit balance. Subscriptions auto-renew until canceled. You can cancel anytime through your Stripe customer portal — cancellation takes effect at the end of your current billing period.
Credit packs are one-time purchases. Credits do not expire but are non-refundable once used. Unused credits remain associated with your account indefinitely.
Refunds. Subscription fees are generally non-refundable. If you believe you have been charged in error or the service experienced significant downtime that prevented you from using paid features, contact us within 14 days and we will review on a case-by-case basis.
6. Acceptable use — what you cannot create
velmira.ai is a tool with significant potential for misuse. The following are strictly prohibited. Creating or attempting to create such content will result in immediate account termination without refund and, where applicable, referral to law enforcement.
Sexual content (NSFW)
- Nudity, sexually explicit imagery, or content of a pornographic nature.
- Sexually suggestive content, including content that emphasizes sexual features or is otherwise intended to be titillating.
- Even “tasteful” or “artistic” nudity is prohibited on this platform.
Content depicting minors
- Any sexual, suggestive, or otherwise inappropriate content involving anyone who appears under 18.
- Realistic depictions of children in any compromising context.
- This is a hard line and has no exceptions.
Real people without consent
- Deepfakes, face-swaps, or non-consensual likeness use of real individuals — celebrities, politicians, private individuals, anyone.
- Content designed to impersonate, defame, or mislead about a real person.
- Content of public figures depicted doing things they did not do.
Violence and harm
- Graphic violence, gore, or imagery glorifying real-world violence.
- Content encouraging self-harm, suicide, or eating disorders.
- Content promoting terrorism or organized violence.
Hate, harassment, and discrimination
- Hate speech or imagery targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or similar protected categories.
- Harassment of identifiable individuals.
Illegal content
- Content depicting illegal activity in a manner that promotes or facilitates it.
- Content infringing on third-party intellectual property (copyrighted characters from existing works, trademarked logos, etc.).
- Content violating any applicable law in your jurisdiction or ours.
System abuse
- Automated or scripted access designed to circumvent quotas.
- Attempts to reverse-engineer, scrape, or extract our prompt engineering or model configuration.
- Sharing your account credentials with others.
- Reselling generations or building services on top of velmira.ai without written permission.
7. Enforcement
We may review content generated through the service to enforce these Terms, using a combination of automated filters and human review. If we determine content violates these Terms:
- We may remove the content.
- We may suspend or permanently terminate your account, with or without notice.
- For severe violations (especially content involving minors), we will report you to the appropriate authorities and preserve relevant data as required by law.
Terminated accounts forfeit any remaining subscription time and credits. No refund is owed.
8. Ownership of generated content
You retain such rights as you may have in the prompts you submit and the characters you define. AI-generated images occupy unsettled legal territory — in many jurisdictions, purely AI-generated output may not be eligible for copyright protection. Consult a lawyer if this matters to you.
You grant velmira.ai a non-exclusive, worldwide license to host, store, and display your characters and generated images for the purpose of operating the service for you. We do not use your content to train AI models.
Commercial use. Subject to the acceptable use rules above and any restrictions imposed by the underlying AI model providers, you may use your generated images for personal or commercial purposes. We make no warranty that any specific generated image is free of third-party rights.
9. Intellectual property
The velmira.ai service, including its software, design, name, logo, and all non-user-generated content, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUT.
AI image generation may produce results that are inaccurate, offensive, or otherwise unsuitable. You are responsible for reviewing what you generate before using or sharing it.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
You may stop using the service at any time. We may terminate your account at any time for violation of these Terms, suspected fraud, or for any other reason in our reasonable discretion. Sections that by their nature should survive termination (ownership, disclaimers, limitations of liability, indemnification) will survive.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to active users with at least 14 days' notice. Continuing to use the service after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which we are domiciled, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction, except where applicable consumer protection law mandates a different forum.
